Acceptance of Terms

Welcome to QuickScan. These Terms of Service ("Terms") govern your access to and use of the QuickScan mobile application ("App," "Service," "we," "us," or "our"). By downloading, installing, or using QuickScan, you agree to be bound by these Terms.

If you do not agree to these Terms, please do not use our App. We reserve the right to modify these Terms at any time, and your continued use of the App constitutes acceptance of any changes.

Description of Service

QuickScan is a QR code and barcode scanning application for iOS devices that allows users to:

• Scan QR codes and barcodes using the device camera
• Store and manage scan history
• Generate QR codes
• Access product information and website links from scanned codes
• Share scanned results with others

User Accounts and Registration

Currently, QuickScan does not require user registration to use basic features. However, if we introduce account-based features in the future:

• You must provide accurate and complete information
• You are responsible for maintaining the confidentiality of your account credentials
• You are responsible for all activities that occur under your account
• You must notify us immediately of any unauthorized use of your account

License and Restrictions

License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App for your personal, non-commercial use on devices you own or control.

Restrictions

You agree not to:

• Copy, modify, or create derivative works of the App
• Reverse engineer, decompile, or disassemble the App
• Remove, alter, or obscure any proprietary notices from the App
• Use the App for any illegal or unauthorized purpose
• Attempt to gain unauthorized access to our systems or networks
• Interfere with or disrupt the App or servers connected to the App
• Use any automated system to access the App
• Transmit any viruses, malware, or harmful code
• Use the App in a manner that could damage, disable, or impair the App

User Conduct

You are solely responsible for your use of the App. You agree to use the App in compliance with all applicable laws and regulations. You must not:

• Scan codes without proper authorization when applicable
• Use the App to violate any person's privacy rights
• Engage in any fraudulent activities
• Harass, abuse, or harm others through the App
• Impersonate any person or entity
• Violate any intellectual property rights

Third-Party Content and Links

QuickScan may provide access to third-party websites, content, or services through scanned QR codes and barcodes. We do not control, endorse, or assume responsibility for any third-party content or websites.

When you access third-party content:

• You do so at your own risk
• You are subject to the third party's terms and privacy policy
• We are not responsible for any damages or losses caused by third-party content
• We do not guarantee the accuracy, safety, or legality of third-party content

Intellectual Property

The App and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by QuickScan, its licensors, or other providers of such material and are protected by copyright, trademark, and other intellectual property laws.

The QuickScan name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of QuickScan or its affiliates. You must not use such marks without our prior written permission.

Disclaimers and Limitation of Liability

Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The App will function uninterrupted or error-free
• Defects will be corrected
• The App is free of viruses or other harmful components
• Results obtained from the App will be accurate or reliable

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL QUICKSCAN BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your access to or use of or inability to access or use the App
• Any conduct or content of any third party on the App
• Any content obtained from the App
• Unauthorized access, use, or alteration of your transmissions or content

IN NO EVENT SHALL OUR AGGREGATE LIABILITY EXCEED THE AMOUNT YOU PAID US, IF ANY, IN THE PAST SIX MONTHS FOR THE APP.

Indemnification

You agree to defend, indemnify, and hold harmless QuickScan and its officers, directors, employees, contractors, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the App.

Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including but not limited to if you breach these Terms.

Upon termination:

• Your right to use the App will immediately cease
• You must delete the App from your device
• All provisions of these Terms that by their nature should survive termination shall survive

Dispute Resolution and Arbitration

Informal Resolution

Before filing a claim, you agree to try to resolve the dispute informally by contacting us. We'll try to resolve the dispute informally by contacting you. If a dispute is not resolved within 30 days of submission, you or we may bring a formal proceeding.

Binding Arbitration

You and QuickScan agree that any dispute, claim, or controversy arising out of or relating to these Terms or the App shall be settled by binding arbitration, except that each party retains the right to seek injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of a party's copyrights, trademarks, trade secrets, patents, or other intellectual property rights.

Class Action Waiver

YOU AND QUICKSCAN AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which QuickScan operates, without regard to its conflict of law provisions.

Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our App after those revisions become effective, you agree to be bound by the revised terms.

Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.

Entire Agreement

These Terms constitute the entire agreement between you and QuickScan regarding the App and supersede all prior and contemporaneous agreements, proposals, or representations, written or oral, concerning the subject matter.
